These Terms of Service ("Terms") govern your access to and use of the HomeWatchOS website and application (the "Service"), operated by SAJMedia Marketing ("HomeWatchOS," "we," "us," or "our"). By creating a workspace or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
01. The Service
HomeWatchOS is software for home watch professionals. It provides tools to document visits, generate reports, share homeowner portals, coordinate vendors, manage issues, schedule work, and bill clients. HomeWatchOS is a software tool — it does not itself inspect, watch, or maintain any property. The professional using it delivers that service.
02. Your account and workspace
You access the Service through a workspace identified by a workspace code. You are responsible for keeping your workspace code confidential and for all activity that happens under your workspace. Don't share it with anyone you don't intend to give full access. Notify us promptly if you believe your workspace has been accessed without your authorization. You must be at least 18 and able to form a binding contract to use the Service.
03. Plans, billing, and subscriptions
HomeWatchOS offers a free plan, a time-limited free trial of paid features, and a paid subscription ("Pro"). By starting a paid subscription, you authorize us, through our payment processor Stripe, to charge the applicable fee on a recurring basis until you cancel.
- Renewal. Subscriptions renew automatically each billing period at the then-current rate for your plan, unless you cancel before the renewal date. If you joined at a founding rate, that rate stays locked for your account as described at signup.
- Cancellation. You can cancel anytime; your paid features remain active through the end of the current billing period. We don't provide prorated refunds for partial periods unless required by law.
- Free trial. If your trial ends without upgrading, your account moves to the free plan and your data is preserved.
- Changes. We may change plan features or pricing prospectively, with notice for any increase that would affect your locked rate.
04. Payments you collect from your clients
The Service lets you collect payments from your own clients, including recurring package payments, through Stripe Connect. When you use this feature:
- You are the merchant of record for those transactions. The business relationship, the service delivered, refunds, disputes, and any applicable taxes are between you and your client.
- Funds flow to your connected Stripe account, subject to Stripe's terms and payout schedule. You must complete Stripe's onboarding and keep your account in good standing.
- HomeWatchOS is not a party to your transactions and is not responsible for collecting, remitting, or refunding amounts you charge your clients.
Your use of Stripe is governed by the Stripe Connected Account Agreement and related Stripe terms.
05. Acceptable use
You agree not to misuse the Service. That includes not: breaking the law or infringing others' rights; uploading content you don't have permission to store; attempting to breach security, disrupt, or reverse-engineer the Service; using it to send spam or unauthorized communications; or storing information about individuals without an appropriate basis to do so.
06. Your content and responsibilities
You retain ownership of the data you put into HomeWatchOS ("Your Content"). You grant us the limited rights needed to host, process, and display Your Content so we can provide the Service to you. You are responsible for the accuracy of Your Content and for having the right and any necessary consent to store information about the homeowners and properties you manage.
07. Intellectual property
The Service — including its software, design, and branding — is owned by HomeWatchOS and its licensors and is protected by law. These Terms don't transfer any ownership of the Service to you; you receive a limited, non-exclusive, non-transferable right to use it while your account is active.
08. Third-party services
The Service relies on third parties such as Stripe (payments), Netlify (hosting), Resend (email), and Anthropic (AI features). Your use of features powered by these providers may also be subject to their terms. We're not responsible for third-party services outside our control.
09. Disclaimers
HomeWatchOS is a tool to help you document and run your home watch business. It is not a guarantee about the condition of any property, and it does not perform inspections or watch homes itself. Features like GPS check-ins and reports record what you do; they don't replace your professional judgment or on-site care.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that it will meet every requirement.
10. Limitation of liability
To the fullest extent permitted by law, HomeWatchOS and SAJMedia Marketing will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.
11. Indemnification
You agree to indemnify and hold harmless HomeWatchOS and SAJMedia Marketing from claims, losses, and expenses arising out of Your Content, your use of the Service, the services you provide to your own clients, or your violation of these Terms.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you materially breach these Terms or use the Service in a way that could harm others or us. On termination, your right to use the Service ends; we'll make reasonable efforts to let you export Your Content unless prohibited by law.
13. Changes to these Terms
We may update these Terms as the Service evolves. We'll update the "Last updated" date, and for material changes we'll provide reasonable notice. Continuing to use the Service after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the United States and the state in which SAJMedia Marketing is organized, without regard to conflict-of-law rules. Any disputes will be handled in the courts located there, unless applicable law requires otherwise.
